FL HOA COMMUNITY POLL

The FL Mandatory HOA that we exist in via it's newsletter is conducting this poll: "This will be a regular section that will give you an opportunity to voice your opinion through a community survey. This edition's question:"........"What do you think is the one thing that can really bring this community together?"

To respond we are directed to call the newly elected secretary/treasurer or email our response "on or before Saturday, May 24th 2008." Our response is as follows:

It's our opinion that "the one thing that can really bring this community together" is more HOA disclosure and transparency, accurate, documented complete financial statements, much lower HOA "assessments," and the ultimate dissolution of the oppressive, unnecessary mandatory HOA operating here in the interests of the HOA Industry Service Providers.

We purchased and closed (in a lawyer's office) on this house in late November of 1997, and ever since then, we have had the most appalling and demeaning experiences with this HOA et al. The incomplete "financial statements," the gross errors, threats, harassment, and maliciousness have been overwhelming!

My husband and I are listed as the "owners" - titleholders on both the mortgage and deed. However, due to the incompetence and/or outright ignorance of the HOA et al, I have been characterized as a non-owner among other things, my legal name is consistently misspelled or wrong, and unbelievably, even a third name that neither of us recognize was added to our address by the HOA lawyers in their letter to us re: the petition drive I did in 2007 to try to lower the excessive and undocumented HOA "assessments" demanded here under penalty of lien and HOA foreclosure.

I characterize the operation of this mandatory HOA as typified by the "no swimming" sign(s), bogus undocumented overcharges for HOA "assessments," incomplete "financial statements," and the overall environment here of deception, harassment, and maliciousness. We are mandatory HOA titleholder "members" and as such, we are protesting, unwilling victims of this appalling, demeaning, mandatory HOA.

Our legal names as listed on our first mortgage and warranty deed are: (initials used here for privacy)LLO & KGK. We believe that you may be aware of some of the gross discrepancies, untruths, and conditions that exist in this mandatory HOA Planned Unit Development "community."

Please let's do something about the appalling mandatory HOA situation being imposed here. Let's not allow the excessive, ever rising HOA "assessments" that continue to defraud us; as the HOA et al requires us to pay the HOA "dues/assessments" owed by the numerous mortgage foreclosures and bankruptcies already in existance here in addition to making us pay the undocumented HOA nonsense costs, overcharges, and dubious fees that are being strapped on us!

The HOAs are out of control.

The HOAs are out of control. My HOA (Beacon Wooods East) is trying to foreclosure on a lien that they placed on my home for dues owed which is nonsense as I have all documentation of dues being paid. Unfortunately unless you are low income and qualify for legal aid or you are wealthy enough to spend thousands on an attorney you are screwed. I have to place $647+ to get teh lien off my house before I can take them to small claims. The system is truly messed up.

The HOAs are basically businesses that collect money for a service however they are not regulated by any government entity. They are basically their own government.

I have joined CCFJ.net to get the latest information so I can take it to a meeting with my local House of Representative member tomorrow to discuss the issue and try to get the laws changed. In the meantime, I am trying everything I can to get Homeowners to stand up and fight.

Good for you! What state are you in? We all need to do as much as we possibly can to overcome and eradicate this evil HOA Industry scam! No one willingly gives up their Constitutional Rights because they needed a place to live and bought a newer house! The HOA Industry and their lawyers think we are stupid sheeple and that they can force us to pay them under penalty of HOA foreclosure of our homes, and you know what, they can because the courts allow them to do it!

We know, and the HOA made a monkey out of me!

By definition HOAs are a magnets for big problems. Why? Because normal people would rather simply pay their taxes and get on with their daily lives and leave others, and their money, alone. So, instead of normal people being on the board, self serving volunteers flock to the board like moths to a light bulb...or flies to ....!

Anaheim, CA has excellent services, but we pay an HOA fee every month to not receive all of those services. Other than vehicle gates, that the volunteers have all but destroyed with their extremely poor decisions, there is no reason for this HOA. Normal neighborhoods don't pay an HOA fee and get full services.

As for the gates, I'm more concerned with what is in the tract, the five volunteers, than what is outside of it. The volunteer directors are continually coming up with the stupidest ideas. And petitions for Recall of the Board aren't enough to teach them how stupid they are. Petitions for Veto of Rules Changes: Same thing. They still come up with their stupid ideas while neglecting their responsibilities as defined in California statute.

But Anaheim, like other cities, is hands off when it comes to doing anything for the residents here. (I'm not including the five volunteer directors; they do what they want. And, they are refusing to show the financial documents.) Maybe taking them to small claims court is going to do some good. I'm hoping the attendance of someone from the office of our state representative at the next board meeting will turn the tide.

The bottom line is this HOA thing is not showing any benefits, only problems, for my neighbors and I. We got stuck with this thing and we're not happy about it!


PLEASE!!! Does anyone know

PLEASE!!! Does anyone know about 'Xeriscape' landscaping and Florida HOAs? We have a home owner that blatantly insists he can "turn" his yard into "Xeriscape Landscaping". Removing the lawn, and hedges, ect. required by the Covenants, saying a "new law" was passed stating as such. I can not find any such law. Is there one? We live in Florida. He is on the board, and the rest of the board OKed it. The ARC, did send him a letter stating he was in violation, with no response. We do not have a Management Co. We are a HOA of 130 houses. Is there a law and what can we do as concerned homeowners.

"720.3075 Prohibited clauses in association documents.--
(4)Homeowners' association documents, including declarations of covenants, articles of incorporation, or bylaws,
entered after October 1, 2001, may not prohibit any property owner from implementing Xeriscape or Florida friendly
landscape, as defined in s. 373.185(1), on his or her land."

It sound's like he can turn his yard into "Xeriscape Landscaping".

my Hoa had my land lord give us a 3 day notice Last week to move because my neighbor hates renters and she kept on calling the police they came there was no problem my dog got out we catch him wright away she call the dog pound she complaints about my kids but other loud kids on the block Wich she is Buddys with she Dont say nothing well she lies and lies well they said if we Dont get out even though we pay on time our rent they where going to find him 1000,dollars a day what can we do I am unemployed and my wife is barely making ends meet we have5 kids at home thank you in Las Vegas.
