Renters Rights

Hello, I'm hoping someone can help me. I'm a single mom with 3 teenage sons and have a neighbor who is constantly complaining about my sons to our HOA. Now my landlord has been asked to attend a hearing regarding the violations (such as skateboarding and hanging out with their friends in the common area and other things that are blatantly untrue). My landlord has been very kind and supports me so she asked if I could attend the meeting to defend myself and they will not let her bring me to the meeting. A lot of the complaints are blatantly untrue and I would like to be able to defend myself against this person who has screamed at my sons and told them she felt "renters" didn't belong there. If anyone knows what my rights are in California, or where I can go to find out what my rights are I would really appreciate it. Thanks!

Excuse me-I hope someone helped you-I know the date is from November on your question. I just saw it today. I would call the local police dept. and make a complaint of harassment against the "neighbor" I would also go to the UHD/Fair Housing Dept. and any local Governmental entities that oversee such rental properties. Go with a statement from your landlady that you are an "authorized representative' of both her and yourself in these discussions. you can do a limited Power of Attorney with her even, to help show your "standing" there are legal requirements to such, find andfollow them, I am not a Californian-but perhaps there is a Renter's Rights Group near you? NOLO PRESS (a legal self-help publisher) may also have the books and materials you need for purchase, you can also check your local public library, ask your librarian for help-through inter-library loans such books can be sent to your local library.

OH YEAH, MAYBE YOU ALREADY DID THIS-BUT I FORGOT TO MENTION:

FIRST OF ALL-Also-make sure your kids ARE BEHAVING-follow your sons around (sorry to advise "pop- up visits" but" you might want to observe to make sure they are actually "behaving" as they say they are-or at least if their friends aren't behaving and your sons are being the audience for the misbehavors you'll know "who" is causing trouble if any. BTW-my apparently well-behaved kid-got caught by me-being reckless with a laughing cohort. Boy was I mad at my young'n! NOTE: This was many, many years ago- So, even if your kids are terrific-sometimes they can get a bit out of hand when just their friends are around, egging them on. Best Wishes!

I too just saw your blog -- anyone can go to a HOA meeting. If you are not the homeowner you cannot vote. HOA meetings are open to the public -- you can go.


You can accompany your

You can accompany your homeowner to a hearing. A homeowner is allowed to bring any evidence or witnesses to a hearing. Since hearings are in executive session, a tenant or homeowner cannot just show up for this portion of the meeting.
