Terrible neighbors, HOA battles, Cops, Courts...... Revenge! This time the good guy came out on top.

I live in North Carolina. Huntington Ridge is the name of my Subdivision. It is governed by an HOA. I lived there since year 2000, the trouble began in late 2004.

A couple (lets call them Randy and Joyce) purchased a large expensive house directly across the street from mine in 2003. After they moved in they started throwing their weight around, threatening to sue the HOA, neighbors, and me over the most rediculous things. They spoke often about their lawyer. These folks were really crazy, made no sense and were mean. I decided to distance myself from them. Being a nice guy I would occasionally waive as I passed them by but not speaking. They just looked at me with a snooty condesending look.
One day when I was checking my mail the man came over and threatend to sue me for his basement flooding in a recent heavy rain. I lost it. I told him that I didn't want to hear him threaten to sue me anymore. I told him that I don't give a crap about his lawyer or his problems and he needed to keep it to himself. A year went by with no problems.

In August 2004 the cable company cut into a water line in front of one of my lots (I have 3 adjacent buildable lots with my home on the middle one). I asked the cable man where did that water line run because everyone in the subdivision was on private wells. He said he didn't know, and the pipe was not on any map. Some research revealed that it was a line that feed the house across the street, put there by the origional developer to avoid drilling a well, the same developer that sold me my lots.
I wrote a letter to Randy explaining that his water line ran in the middle of my lot rendering the lot unbuildable and I was willing to help him move it or help pay to move it to the perimeter of the lot. He responded by saying that it will not be moved and threatend to sue me if I moved it. I contacted the developer and explained that he sold me an unbuildable lot, that he needed to move the line or buy the lot back. The developer came and moved the line by bypass placing a new line onto the lot line perimeter. The work took a week to accomplish. On the last day, Randy and wife came over to my property, threatening to sue, lawyer talk, etc. I told them to leave or I would call the police. "If he didn't like it, Sue Me!".

Later that night at around 9:30 pm the police came with a warrant for my arrest. Randy went and swore out a warrant accusing me of communicating threats (he said that I told him that I was going to "woop his ass"). The cops were mean and nasty. One of them spit in my face and invited me to hit him, repeatedly trying to get me to assault him, over and over. It was looking bad until my wife came to the door with our video camera. The battery was dead, but the sight of that camera made those cops into professionals very fast. Wish I had caught it on tape.
We went to court a month later. Randy, Joyce, and their maid were on the stand telling the judge how out of control I was, how I drank excessive amounts of alcohol, how mean and crazy I was, they were "afraid to let their kids play outside". They were very convincing. We ran out of time that day and my trial rescheduled for another month later. On the second day of trial, Randy said that they had more problems with me "he threatened me again last Tuesday your honor". Thank God I had taken my work schedule with me. I am an Airline Pilot and my schedule revealed that I was 2000 miles away, all day, last Tuesday. The case was thrown out because of this.

Pissed off and hell bent on revenge I began to research these people. Using the net, researching land records, divorce records, securities and exchange site, I found some good info on these folks, I put it to use.

The woman was Joyce Lynn Rocco. Her late husband Dan Rocco died in an airplane crash in April 2002 leaving behind 3 grown sons and their step mom Joyce. Dan Rocco is listed on the "Bush Body Count" that can be found on the web. I found that Dan Rocco was an executive at ChoicePoint, the SEC and HighBeam research revealed that he had massive holdings of his company stock ($20 million worth).
I also found that there was a probate case open in Manatee County Florida. I bid into a Tampa trip. I flew my jet plane to Tampa, rented a car and drove to the court house.
Thanks to Florida's Sunshine Law, all court documents are public record, even probate. I just walked right in and read them.
The filed estate inventory that Joyce signed under perjury did not reference the $20 million in stock, neither did the will.
I made copies of what I had found and mailed it to all attorneys of record in the case.

The results are spectacular! Joyce was accused with perjury, contempt, and disregard of a court order. She was sued very badly, The stepsons wanted the money returned and Treble Damage ($51 million). The house across the street from me is now empty. I heard it was seized by the courts to repay the estate. Randy and Joyce are now divorced. I don't know where Joyce is. Randy is living in a decrepid old house in a very bad part of town. I go by and waive at him occasionally.

Oh, the cop.....he was fired for steroiod use. Somebody found that he was using them and wrote a letter to the SBI. They must have given him a drug test.

I am so glad your wife had the presence of mind to attempt to film! I am taking a lot of pictures to guard my property condition evidence and comparables to other homes nearby and in the "hood. I am SO pleased for you-you are an INSPIRATION!!! I have a similar potential piece of nut cake on my block "running the HOA Board" by PROXY-actually he's only the money hungry Treasurer-who WAS looking forward to getting a Law Degree and harassing all us po' helpless peeps for his own salutary and financial aggrandizement. When HE got on the Board-all the sh*t escalated-it was about CONTROL of HIS little Fiefdom. HE was the one running around waving at people as he wrote them up until I "outed" him-boy was he ever pissed! Started screaming at me in the middle of the street and his dear wife gunned her van and made like to hit me twice! If I die others will know who and why and certainly it will be obvious "HOW." I FULLY expect him to try some such bull as was tried on you- on me-TODAY he sent his little-LITTLE girl up to ride her bike by me as I watered the lawn today BEFORE our light freeze/temperatures plummet(note-she is WAY to young to be on a busy street-out in the MIDDLE of it with oncoming traffic.) A van had to stop short because she was in the middle of the street! Even BEFORE he encouraged her to go as far up to me (in the middle of the street) as she could get. That is just plain STUPID!!! We have a high-volume traffic neighborhood. He's going to get her hurt-but hey-what can I DO? If I contact law enforcement or child protection-I COULD be considered as harassing back since he and his cronies are already "working" me as a gang of bullies. I am standing up to them (in a legal and forthright above board manner-unlike them and their nefarious secret tactics.)

The guy accross the street tried to send his kids around me too, but I always had my wife come outside with the camera when they approached. We have two little dogs too-but they have to stay in a lot and so are not so vulnerable. For some time now-I had been anxious about them doing something to my cat and now-I believe they have. (There is no other way to GET me and my family) as I WEEKLY photograph and document the condition of the general neighborhood and my house in PARTICULAR. Also, when I paid my HOA FEES ON TIME I decided to send a Money Order, so THEY couldn't get at our Checking Account and got all the Paperwork NOTARIZED and took the Notary with me to mail it! Now, When I leave to go ANYWHERE for more than 30 minutes I lock the dogs in the house. The BLOWBACK is going to be enormous against these control-freaks, eventually they will step on the WRONG TAIL-someone with more money than me and I hope they get their ears pinned back hard! More power to you, Captain Kirk! You can also access Florida public records over the internet and print out copies of the documents, I do it all the time. There are some very interesting public records on our HOA friends and neighbors. That's how I discovered that our former HOA president and her husband - the treasure & secretary, had both filed bankruptcy, and had some other questionable filings as well. They do not seem to be able to stand the truth or face realty when it is presented to them in documented form.

I have pulled Manatee county records from the net, but court filings are only veiwable in person at the clerks public viewing room in Bradenton. For instance, you can view deeds, notices of intent (building permits). But when a case is ongoing you have to go to the clerks computer. Don't know why. Yaah, but the current HOA Pres. we now have is even worse - the property taxes on her rental house in this HOA are still unpaid. And according to the FL Div. of Corps. we have no sec-tres listed on the 2007 corp. report AND the registered agent resigned 9-5-07. How's that for an incompetant HOA?
Just want to mention that this HOA does have well-know CAI lawyers located in Maitland, so I guess everything is A-O.K. here!

property tax? Does your HOA collectively pay the property tax for the whole complex (hood?). I have heard of some where that is the case. Bad Idea...one house may be larger than another or water-front where some are not. The smaller houses end up subsidising the larger ones for tax purposes. Completely undemocratic. There is probably a clause in your bylaws that state that only memebers in good standing may serve on the board. If they are behind then they can't be on the board.

If they are responsible for their own tax then just sit back and enjoy the show. The county will eventually foreclose and you will get new neighbors.

Thank you for the excellent advice. You are right, this is the only way to sucessfully handle these agressive controlling numb-skulls. Once you find out that they are financially buried,have'negative equity', and have problems paying their property taxes, one begins to understand why they are so difficult to deal with. They volunteer for the "board" so they can compensate for their ignorance and inadequacies by bullying others and trying to extract money from them (which they usually desperately need) to help pay their bills, taxes, or whatever. They are usually very stupid, very greedy, and very controlling. We've seen several "boards" and management companies so far and they all seem to exhibit these same "qualities." We intend to investigate the "control freaks," CAMs and managements co.s, HOA CAI lawyers (State Bar Asso. complaint records) very thoroughly. We will report back with any interesting info also. HOAs et al are in "ratbang" territory now.

Hi Anonny-I have actually let it be known I will sue for harrassment-if our local "Ho-as" didn't recalculate their strategy and go back to minding their own business. I wasn't casual-I wasn't bluffing. I called and said what my next move after their next harrassing act would be. Not all threats are idle-but the bible says "Do Not Go Forth Hastily To Strive With Thy Neighbor!" So, when I let them know they had crossed the line-I gave them an option of deciding whether or not a real-honest to goodness knock-down drag out court fight was in their best intersts. They are "laying low" now till they can enlist some more supporters and try to find a way to "get us" that is a little more than obviously personally motivated. HINT-if you are one of the Bully's "cheesy" pals-you're safe-even if you break CC&R's-or if he thinks you have strong allies you're not likely to be his "target" but if you are like us-not "aligned" just living your normal life and not being anal retentive-or part of the "herd" VOILA! You're buzzard meat. Yep! I hissed the "S" word-and yep-I MEAN it-but-they need ONE MORE TRANSGRESSION-and I'll BAG THEM! Legally, with additional damages for the torts of intentional infliction of emotional distress and for the horrific impact they have had on my health. HELL needs to be dug deeper and the fires stoked hotter for such lousy, greedy, sadistic monsters. I put them in the same class as molesters and murderers-they molest your spirit and murder your peace. They are (as Hannah Arendt said in her report of the NAZI's PROOF OF-"The BANALITY of EVIL"). So don't lump all who utter the "S" word as empy-talkers-some of us just want to make sure the red legal carpet is thoroughly rolled out for us before we step out! Yea sometimes you can avoid

Yea sometimes you can avoid a costly court battle by convincing the other side that you would win against them in court. For instance, the HOA I live in is trying to change the restrictive covenants despite our existing ones stating that they can't be changed for 20 years (still have 5 1/2 more years to go). For about 4 years I have kept them from implementing changes. They are again trying and it may well lead to a lawsuit.
Depends on what changes they want to make. I don't want any changes, but I don't want to spend money suing them for inconsequential (to me) changes. They havn't disclosed the changes yet, but I think that they will bring them at the next meeting and have a lot of proxies with them in hopes of railroading it thru. Probably will be something we won't like since they havn't disclosed them to the membership yet.

I don't mind having restrictions and rules that I agreed to when I bought my land. I just don't want changes that I never agreed to being imposed on me. For instance, one of my lots can be sold and the minimum sq ft bulding is 2000 right now. If they change it to say 3000 sq ft, then there are fewer people that can afford to build on it, thus reducing my lot value since there would be less demand. in this case I would sue.
If they say no motor homes parked in the drive way, then I probably won't sue because I don't own or ever plan to own motor home. I wouldn't particularly like the no motorhome rule but I won't spend hard earned money to fight it. Battles are plentiful with these ass holes, I can only afford to fight the important ones.

Good for you! Pick your battles carefully. Well spoken-always calculate your risk. Kirk you are a tough and intelligent person, you are contemplative as well as action-oriented, which makes you a "hard target." "They" are pip-squeak manipulators who must "join" and be conformed into HOA "Mac n'Cheese" so that they can justify their narrow-minded value systems. This country wasn't settled by such wimps, nevertheless they think of themselves as having better values than other more independent types and so must try to put their values on others to build their self-image. It is worse than pathetic! My neighborhood "nutjob" is currently limited to menacing "drive-bys" in his pretty, golden, massive, Dodge Ram- with engines gunned loudly by my house. I just smile and chuckle softly, what an idiot! Get a life! So-I stood up to you and you can't "get" me-what a disgraceful way for a former "Marine" to act. he's still "brain-washed" and needs a good de-programmer. Kirk, you seem to know a lot

Kirk, you seem to know a lot about the law. I was wondering if you, or anyone else could answer a question for me.

My HOA counts, in their annual budget, money collected for violations before they are even received. In my eyes, this is a quota for them and by all means they will do what is necessary to collect. I don't see how they can pre-guess how many people will violate the CC&R/Design guidelines/etc. Is this legal?

On a side note, This past budget, they counted for $20,000 in violations (not yet violated). On last year's audit, it showed they collected $90.000!! And from reading the minutes from several meetings, I can find months where they have collected up to $12,000 in one month! I have not yet added all the months, as I don't know if I should start from the beginning of the year, or the beginning of the fiscal year.

Please let me know what you come up with. I have been looking at all statutes, and there is nothing in regards to this matter, that I can find.

You must have a big

You must have a big subdivision if they are collecting those big amounts.

If they "plan" on budgeting for receiving fines to supply the coffers it only benefits you since your annual assessment will be offset by the fines (yet to be collected)so your assessment should be less since they chose to budget this way.
I don't know about your state laws, but NC law does not specify about budgeting with fines. Get to know your laws. It is your ONLY protection against the HOA. If you think the y are over zealous or fining fo rthings they shouldn't......get to know your laws, CCRs, Bylaws.

Sorry I wasn't more help, but every State has different laws, every neighborhood has different CCRS.


Just for the record, I'm in

Just for the record, I'm in AZ. I cannot find anything about it. Our community consists of almost 4000 homes, and some businesses as well. Yes they fine and charge assessments to the businesses. One business is in a huge court battle with them over a sign they had up BEFORE they changed the guidelines, and they are being charged $200 per DAY!

A good majority of us feel as though we are living in the twilight zone with all the crazy stuff that is happening.

The real problem that you

The real problem that you are being faced with, is that your community is so large, that in the event of lawsuit, it will go all the way to a jury, perhaps appeals. I say this because the board asessmes the coomunity to fund the lawsuit(s). Since this is divided amoung so many homes (4000). the amount is barely noiticable to the individual owners.
For instance...If the board has to pay a lawyer $8,000 to fight you in court, the individual owners will have to be assessed $2.

My neighborhood has but only 30 owners, the assessment is felt should they have to litigate, making them more reluctant to do so.

This is probably why your board is so eager to litigate, and will do what they want (so sue us attitude).

The major compaliant nation wide is that there are no governing body for HOAs. You have to sue them to get them to operate correctly.

I would recommend that you paint the inside of your home with new paint, clean it to sparkeling, sell it fo rthe most you can get ( tell prospective buyers how you love living there and love the HOA,,,"we have to relocate for jobs").....buy another home that is not in a hell hole like that.

Sorry, but until there is major legislation reinning in HOAs, there is only going to be trouble living in one. Reading articles on the net AZ is second only to Florida when it comes to HOA abuse to tits owners.

That is a beautiful story Kirk727. MY husband and I moved into a nice HOA community in Phoenix about 8 mos.ago. We've got crazy renter neighbors, just not quite as bad as what you described but they keep trying to escalate. Their landlord has tried to evict them but they're the "Prove it, it's your word against mine," types.So I will research them as you did with your crazies and keep doing what I can. (You wouldn't believe how much they tear their place up.)
I just have to say it again, that is a beautiful story.

Dealing with renters is almost always difficult for landlords, even worse for thier neighbors because you are not even getting their rents but still have to put up with them.

First place I would look would be the national sex offender registry. If you find something on him/her...embarrass them into moving (make copies and put under windshield wipers of all neighbors).

Check their criminal records, register of deeds site for your county, try to find his last address (maybe he is a dead beat dad?). search local newspapers archives on his name.

If the name is a Spanish sounding one, then they may be illegal aliens....report him to Customs Boarder Patrol CBS. Don't report them to immigration. Customs is "spring loaded to deport". Immigration and naturalization is a political dumping ground/ bleeding heart/alein advocate. I know this for a fact (different story). Remember "customs".

Think "outside" the box. Ask yourself, why is this person here, where did they come from? The net is a good tool. Lots of stuff you can find for free. If you can't find any past address using his name then try it with the wife's name. Yahoo people finder is good, it usually lists previous possible addresses. There are some pay criminal background check services but I havn't used them.
