fines for garbage pails

we live in a condo that has a rule about where you can store garbage pails. It says they must be stored in your garage. We have a resident who refuses to do that and has been fined for a year. I know wome years ago I read about a court case with this exact scenario and the resident lost and was told to pay the fines. Can anyone point me to that or a similar case
