Another Case of HOA Intimidation and Harassment

You have heard the rumors. Here are the facts, Yes there is a lawsuit Filed by a homeowner against the VVL HOA BOD, however it is a Counter suit filed in response to a civil lawsuit that was first Filed against the homeowner. The civil lawsuit (that you as Homeowners are paying for) was filed on September 20th 2006.

The VVL HOA BOD felt that this situation was causing such harm to Them that they chose to spend your money to initiate this civil Lawsuit against the homeowner. If you know anything about lawsuits, Just to file and to start the whole process usually runs in the Thousands.

If you are not aware, the VVL HOA has some financial concerns at the Moment as stated in last weeks BOD meeting, where to save money, they Are strongly considering or may have even passed a motion to cut back On the open hours for the tennis pro shop, where it would be closed Until afternoon on weekdays. So if they are considering cutting back A staff position to save a few hundred dollars a week, why have they Felt the need to give your money to the law firm of Carpenter and Hazelwood, of course the law firm would not be to happy about that, Since they get paid whether they win or lose. Actually you as a Homeowner of the association pay the law firm whether they win or lose.

So what is causing the VVL HOA BOD to go to this extreme?

A homeowner built a wall at considerable expense to give their home Some great curb appeal. This must be one heck of a wall to make your VVL HOA BOD spend your money on a major civil lawsuit.

pic # 2 the tree looks a lot closer to the front than in pic # 1
the garage door is a different color
and pic 2 makes it appear as tho it is 2 stories while pic one appears to be single level
are these the same exact angles? The curbing around the grass looks different in the 2 pics too.

Of course neither picture shows the trucks parked in front of her house and the garbage in the yard. She is just a greedy person. The HOA is willing to foot all the costs, but she wants more. She is already complaining about being cited for the trucks and garbage. I suppose the HOA will have to go to court for that too. I am sure she will be blasting her sad story here for all of you to read.

I have to look at the yard every day. I called the association to find out why they approved it, only to find that it wasn't approved. She has agreed to multiple compromises and always backs out.

Well "mike" You obviously don't live across the street since there are NO houses across the street- there is no garbage in the yard- it is exactly how it appears. You are a liar! the only compromise the association wants is to make it "their" way- which no one can tell me just what that would be- you must be the same moron that claimed he lives next door to me. It is the same house just

It is the same house just with some major renovations- the ficus is still the same - we added new garage doors-repainted the house and doors and added the courtyard and stone. We also completely relandscaped!All with the approval of the hoa and then voila! they decided it wasn't right! After repeated requests they still can't show us the rule!

Why is it that the Carpenter

Why is it that the Carpenter Hazelwood law firm always seems to be involved in these insane disputes. Joshua M. Bolen, Esq. should advise the board to settle and move on. The whole thing reeks of barrity and fee building to me. Having said that, from his well reasoned letter, you are fortunate to have Steven W. Cheifetz representing you. On the other hand, legal fees are not cheap and it's a shame you have to go through this nonsense rather than be able to just enjoy all the hard work you put into your home. It really does look good.

Good point. The board's legal counsel plays a big role in all this. From the sounds of it, homeowners are kept in the dark like mushrooms and just told what to do. I visit this site every morning for the news articles and seldom read the HOA stories, but this one was so absurd, I forwarded it to a small 70-80 member e-mail group I belong to.

Sad to say this kind of problem is the norm! But CAI and their HOA Attorneys love it...we all know they thrive on CONFLICT!! The "filechurners" are happy with fat wallets but in case not for long.

I'm looking out my window now at a home across the street that has very similar design, colors, and brick work that sold last fall for $850k. What's the problem?

I like it too! But the issue with HOAs is not how it looks, but if it "conforms" to what someone thinks the neighborhood should look like. Most HOAs like all the houses to look similar---they think it adds to the "eliteness" and "property value". Also, it's a whole lot easier to dictate conformity. But I think subdivisions with houses that all have the same colors, landscaping and fences are BORING! and actually detract from the value of the home. People will spend more for a unique home, too. However, HOAs will fight to the death to maintain their "right" to punish those homeowners that do anything different--regardless of what is done and how it looks.

Very true. Last summer, Realtor friends of mine were telling me non-HOA homes were selling at a premium. I too find beige projects with cookie-cutter landscaping very dull and boring, a cultural ghetto. Throw up some gates and you have "gated minds" where individuality is punished and blind obedience, timid compliance, and blandness is rewarded.

Too bad none of you have to live with her. I lived next door to her when she was in the Islands. She is delusional. She does what she wants then goes to meeting and yells at the board because they tell her she needs to submit first. She yells and screams at her neighbors. With all the trucks parked in front of her house, you couldn't tell if she was making the house look better or not. They run their business out of their house. Her kids are drug users (as proven by their convictions). Rules are not for her, they are for everybody else. I don't know why she moved into another HOA controlled area, unless she just wanted someone to fight with. I feel sorry for her new neighbors, but I am glad she is out of here. The last three years have been great.

As of March 2007- the HOA

As of March 2007- the HOA decided to make an offer to settle- they paid all attorneys fees and dropped all complaints and claims against the home. The attorney said it was a "political win" for the homeowner.That doesn't matter. we won! It was a ridiculous use of Homeowner money that could of been spent to improve the community.
When the HOA attorney was asked how much did this cost homeowners, he stated it was private. The homeowner's costs were $5,600. so we can assume the HOA attorney would charge at least that if not more. Thank you to all those who supported our efforts, you are appreciated!
